The courts have finally decided Case: 1:13-cv-00397-SO, Case: 2:13-cv-00182-GLF-EPD and Case: 4:12-cv-02022-AGF filed by Night of the Templar against various John Does in the Northern and Southern District Courts of Ohio and the Eastern District of Missouri. Majority of the Doe Defendants were severed and claims against them were dismissed without prejudice.
However, in Case: 4:12-cv-02022-AGF the action against one of the defendants was dismissed due to Night of the Templar’s failure to timely serve complaint. Despite the laxity of time given, plaintiff was not able to respond to the Order. Thus, the complaint against defendant was dismissed pursuant to Federal Rule of Civil Procedure 4(m)
